In June 2013 in United States v. Windsor, the United States Supreme Court struck down as unconstitutional a portion of the Defense of Marriage Act (“DOMA”). The Supreme Court directed that lawful same-sex marriages in those states that recognize them will be recognized under U.S. federal law. On November 5, 2013, please join NASABA for a webinar exploring the impact of Windsor on a range of employee benefits and employment law issues.
Since the issuance of Windsor, the legal landscape surrounding same-sex marriage has been in a constant state of evolution. Federal agencies have been updating their regulations and issuing guidance in light of Windsor. This guidance and regulation will impact employer’s obligations under a number of federal statutes including (ERISA, the Internal Revenue Code and the FMLA). In addition, since Windsor a number of lawsuits have been filed which challenge the portions of DOMA that remain and which challenge state laws and amendments which restrict marriage to opposite-sex couples. Also, since Windsor officials in various states have begun to issue wedding licenses even if such conduct runs afoul of state law. Both the new lawsuits and the conflicting actions of state actors impact employers operating in these states.
The webinar will address the impact of Windsor by discussing the evolution of the law in Windsor and after, and by providing employers with practical guidance regarding how to address these changes as they impact their business.
